Memphis Police Face Federal Lawsuit Over Brutal Beating of Tyre Nichols

The family of Tyre Nichols, a 29-year-old Black man who was severely beaten by Memphis police officers after a traffic stop in January, has filed a $500 million federal lawsuit against the city of Memphis, its police department, and the officers involved. 

The suit claims the officers were “unqualified, untrained, and unsupervised,” and the beating resulted in Nichols’ death three days later.

Modern-Day Lynch Mob

The lawsuit, filed by lawyers representing Nichols’ mother, RowVaughn Wells, compares the brutal beating to the 1955 killing of Emmett Till, saying Nichols suffered at the hands of a “modern-day lynch mob.” According to the suit, the reasons for Nichols’ traffic stop have “never been substantiated.” 

The officers involved allegedly dragged Nichols out of his car, subjected him to a violent “frenzy of force,” and acted like “a pack of wolves attempting to hunt down their wounded prey.”

Five police officers, all Black, were fired following an internal investigation and were indicted on criminal charges on January 26. Memphis Police spokesperson Maj. Karen Rudolph declined to comment on the ongoing litigation. CNN has sought comment from city officials and attorneys for the five officers charged criminally.

SCORPION Unit: Unqualified and Unsupervised

The five charged officers were part of the police department’s specialized SCORPION unit, created in 2021 to address the rise in violent crime in Memphis. The unit was permanently deactivated after video footage of Nichols’ arrest was released in January. 

The lawsuit claims that the fatal beating was not just the result of five rogue officers, but the “culmination of a Department-ordered and Department-tolerated rampage by the unqualified, untrained, and unsupervised SCORPION Unit.”

National Debate on Policing and Reform

The release of body camera videos and surveillance footage from Nichols’ arrest sparked a national debate on justice in policing and reform, as well as protests and vigils in Memphis and other major US cities. 

The US Department of Justice is reviewing the Memphis Police Department, and will also review specialized units across the US and create a guide for their use.

The five former Memphis police officers indicted in January were arraigned on February 17 on criminal charges, including second-degree murder, aggravated assault, aggravated kidnapping, official misconduct, and official oppression. 

Their attorneys entered not guilty pleas on their behalf. A sixth officer was fired, and a seventh was terminated last month, along with three Memphis fire department personnel who responded to the scene.

Widespread Consequences and Potential Settlement

The 139-page complaint filed in the U.S. District Court for the Western District of Tennessee describes the beating as a “foreseeable product of the unconstitutional policies, practices, customs, and deliberate indifference of the City of Memphis and Chief Davis.” 

Civil rights attorney Ben Crump, who represents the family, announced plans to discuss the lawsuit at a news conference. The complaint does not specify a dollar amount being sought in damages.

Recent high-profile police misconduct cases have seen increasing payouts, such as the settlements for George Floyd’s and Breonna Taylor’s families in 2021 and 2020, respectively. 

The city of Memphis allocated $1.25 million of its police budget for lawsuits in 2023, but experts say any resolution of the Nichols case would likely be significantly larger.

Astronomy enthusiasts in other parts of Australia and the world will still be able to witness a partial eclipse.

Dr. Brad Tucker, an astrophysicist affiliated with the Australian National University, elucidates that solar eclipses transpire when the moon traverses between the sun and Earth. 

Total solar eclipses, wherein the sun is entirely concealed by the moon, occur approximately once every 18 months; however, for one to reoccur at an identical location on Earth, an average of 375 years is required.

Singer and rapper Aaron Carter tragically drowned in his bathtub due to a combination of sedatives and inhaled compressed gas, according to a coroner’s report released Tuesday. 

The Los Angeles County Medical Examiner-Coroner ruled the 34-year-old’s death an accident, but the findings have left some of his loved ones questioning the circumstances.

Autopsy Report Details

Carter, the younger brother of Backstreet Boys’ Nick Carter, was discovered lifeless and submerged in the bathtub of his Lancaster, California home on November 5th. 

The autopsy report revealed that the sedative alprazolam, commonly known as Xanax, and the compressed gas difluoroethane were present in his system. Difluoroethane is typically used as a propellant in air spray cleaners and can produce feelings of euphoria when inhaled.

The combination of these two substances incapacitated the musician in the tub, leading to his drowning. Sheriff’s deputies had last seen Carter alive during a welfare check at his residence at 2 a.m. on November 4th. 

This visit followed reports of him “huffing” an inhalant on an Instagram live video. Carter had requested the deputies to leave, and they complied.

Later that evening, the singer missed an appointment with a drug counselor, as stated in the police report.

Family and Friends Seek Answers

Melanie Martin, Carter’s ex-fiancée and mother of his one-year-old son Prince, expressed her disbelief and grief to TMZ, stating that the autopsy findings “are not closure.” She questioned the report’s mention of Carter wearing a t-shirt and necklace in the bathtub and found it inconsistent with the drowning claim.

Carter’s mother, Jane, also expressed her doubts earlier in March by sharing graphic photos from the scene of her son’s death on social media. She called for a “real investigation” and was critical of the coroner’s conclusion of an accidental drug overdose.

Carter’s Struggle with Addiction

Evidence of compressed air canisters and medications were found in Carter’s primary bedroom and bathroom following his death. The singer had previously been candid about his addiction to huffing, or “dusting,” and his struggles with substance abuse.

In a 2019 episode of The Doctors, Carter revealed that his late sister Leslie had introduced him to huffing at the age of 16. He admitted to purchasing compressed air from stores like Staples and Office Depot to avoid detection, attributing his addiction to feelings of sadness and his identity as a drug addict.

Carter had attended rehab multiple times and was working toward sobriety for the sake of his son, Prince. In September, he voluntarily sought treatment to quit smoking marijuana after losing custody of his child.

A Cheeky Monkey’s Experiment

Eldagsen admitted in a statement on his website that he submitted the AI-generated image as a “cheeky monkey” to test the competition and initiate a discussion about the future of photography. 

He emphasized that AI images and traditional photography should not compete with each other in awards, as they are different entities. “AI is not photography. Therefore I will not accept the award,” Eldagsen said.

Fungal Outbreak at Michigan Paper Mill Claims Life, Infects Nearly 100

A deadly fungal outbreak at the Billerud Paper Mill in Escanaba, Michigan, has claimed the life of a contract worker and left nearly 100 employees infected with blastomycosis, according to a press release from Public Health Delta & Menominee Counties (PHDM) on April 14.

Mill Community Mourns Loss

Brian Peterson, Billerud’s operations vice president for the Escanaba mill, expressed the company’s grief in the press release, stating, “Everyone at Billerud is deeply saddened by this news.” He added, “Anyone who works at our facility is part of our team, and we are keeping this individual, their family, coworkers and friends in our thoughts and close to our hearts.” The identity of the deceased worker has not been released.

Blastomycosis Infections Emerge

Blastomycosis is a fungal infection caused by the Blastomyces fungus, according to the Centers for Disease Control and Prevention (CDC). The PHDM was first alerted to several pneumonia infections among mill employees on February 28. 

On March 3, Billerud was informed of the infections by the PHDM. As of April 14, there were 21 confirmed cases and 76 probable cases among mill employees, with 12 people hospitalized due to the illness.

Temporary Mill Shutdown for Deep Cleaning

The news of the outbreak’s first fatality came just a day after the mill announced a temporary halt of operations for up to three weeks for deep cleaning. Christoph Michalski, Billerud president, and CEO, emphasized the importance of protecting employees and contractors’ health and safety in a company press release.

Brian Peterson confirmed that, in addition to conducting a deep cleaning, Billerud has provided employees with N95 masks, hired an industrial hygienist for guidance, inspected ventilation systems, and replaced filters. 

Local and national health agencies, including PHDM, the CDC, NIOSH, and the Michigan Department of Health and Human Services, are investigating the outbreak.

A recent exposé by ProPublica unveiled that the associate justice has allegedly accepted luxury trips from Republican megadonor Harlan Crow for over 20 years without disclosing these gifts as required by law. 

ProPublica also reported that Crow purchased property from Thomas, which the justice failed to disclose as well.

No Charges for Akron Officers in Jayland Walker’s Fatal Shooting

A special grand jury in Ohio declined to indict the Akron police officers involved in the fatal shooting of Jayland Walker, a 25-year-old Black man, who was killed after a car chase and foot pursuit last summer. Ohio Attorney General Dave Yost announced the decision, stating that the grand jury concluded the officers were legally justified in their use of force.

The Incident and Its Aftermath

The incident occurred on June 27, 2022, when police attempted to stop Walker’s car for a broken license plate light. Instead of pulling over, Walker sped away, leading officers on a chase during which he fired a gunshot from his vehicle. After abandoning his car, he continued to flee on foot, wearing a ski mask and ignoring officers’ commands to stop and show his hands.

Yost explained that Walker reached for his waistband in a motion that several officers interpreted as threatening. Believing he was about to fire again, eight officers fired a total of 94 shots at Walker within 6.7 seconds, leaving him with 46 gunshot or graze wounds. Walker was unarmed during the foot chase, with a gun found in his car after the shooting.

David’s Bridal Files for Bankruptcy Amid Struggling Retail Industry

David’s Bridal, the largest bridal retailer in the US, filed for Chapter 11 bankruptcy on Monday, citing a range of factors including inflation, competition from online retailers, and a shift towards more casual weddings. 

Despite the rebound in weddings following the worst of the Covid-19 pandemic, the company has struggled with financial challenges in the post-pandemic environment and changing consumer preferences.

Struggling to Adapt to Changing Market Trends

The company revealed that the demand for formal wedding dresses, bridesmaid dresses, and related accessories has decreased substantially in the current environment, with an increasing number of brides opting for less traditional attire, including secondhand dresses. This shift in consumer preferences has significantly exacerbated David’s Bridal’s financial crunch.

David’s Bridal has already announced plans to lay off more than 9,000 workers nationwide later this year.

While the company’s stores and e-commerce website will remain open during the financial restructuring process, they are looking for a buyer who can continue to operate the business going forward. If the company fails to find a buyer, it may be forced to close all stores and liquidate.

A Challenging Retail Environment

David’s Bridal is not the only retailer facing difficulties. Bankruptcies are piling up in the retail sector as interest rates rise and discretionary spending slows down. Party City, Serta Simmons, and Tuesday Morning have also filed for bankruptcy this year, while Best Buy, Disney, and Walmart are laying off workers or closing locations. Bed Bath & Beyond plans to close nearly 240 stores this year as part of a larger effort to avoid bankruptcy. 

Analysts at UBS predict that retailers will close approximately 50,000 stores in the next five years due to the increasing prominence of online shopping, higher borrowing costs, and customers tightening their wallets due to inflation.

Second Bankruptcy in Five Years

This is David’s Bridal’s second bankruptcy in five years. The company emerged from its previous bankruptcy in 2019 after shedding $400 million in debt. 

CEO James Marcum said in a statement that the company had made progress since restructuring its business during its previous bankruptcy, but is still “suffering under severe liquidity constraints.” With marriage rates in the United States steadily declining since the early 1980s, according to the CDC, the future of the bridal retailer remains uncertain.

The Impact of Post-Pandemic Weddings and a Shifting Industry

While the number of weddings has increased post-pandemic, this has not translated into success for David’s Bridal. As couples face a higher cost of living, they are increasingly seeking out alternatives to traditional, expensive wedding attire. This trend is pushing them towards secondhand stores, online retailers, and less formal attire for their weddings, further challenging the business model of David’s Bridal.

A Legacy at Risk

Founded in 1950, David’s Bridal boasts a long history in the wedding industry, with approximately 1-in-4 US brides wearing a gown from the company at their wedding. 

The company operates 294 stores across the US, Canada, and the United Kingdom and has a strong online presence, with nearly 90% of brides visiting its website at least once during their wedding planning. Despite this legacy, the company is struggling to adapt to the rapidly changing market trends and consumer preferences.

Employee Layoffs and Restructuring Efforts

David’s Bridal plans to lay off 9,236 employees in three waves between April and August, according to a notice posted on Pennsylvania’s Department of Labor. 

As of April, the company had about 10,000 employees—2,000 full-time and 8,000 part-time. Some layoffs have already begun, with the company stating that the decision to reduce its corporate workforce is in line with market realities and their go-forward approach. However, store employees have not been impacted by these layoffs.

Seeking a Buyer to Preserve the Business

As David’s Bridal navigates its Chapter 11 bankruptcy process, the company’s executives are actively searching for a buyer who can continue operating the business. CEO James Marcum acknowledged the modernization efforts made by the company in marketing and customer interaction processes, as well as the improvements in retail service levels. 

However, Marcum admits that the post-COVID environment and uncertain economic conditions have led them to seek a buyer to secure the company’s future.

The outcome of David’s Bridal’s restructuring and search for a buyer remains uncertain, with the company’s fate hanging in the balance. As the retail industry faces numerous challenges, businesses must adapt to evolving consumer preferences and market trends to survive in a rapidly changing landscape.
